Summary

    Credit servicers authorised in Luxembourg

    Pursuant to the principle of mutual recognition of authorisations as provided for by Directive (EU) 2021/2167, credit servicers authorised in Luxembourg are authorised to perform their services on the territories of other EU Member States or in other States party to the EEA Agreement (EEA) after having completed the following notification procedures:

    • Notification under the freedom of establishment, by establishing a branch in another EU Member State or in another State party to the EEA Agreement
    • Notification under the freedom to provide services in another EU Member State or in another State party to the EEA Agreement

    Changes to initial notifications (including the outsourcing of activities to a credit service provider, where appropriate), as well as the termination of cross-border activities must also be notified to the CSSF by using the notification form available for download in the section “Forms” below.

    Credit servicers authorised in the EU/EEA

    Credit servicers authorised in the EU/EEA that intend to exercise their activities in Luxembourg under the freedom of establishment or under the freedom to provide services are required to complete the necessary formalities with their national authority which will notify the CSSF.  The same holds true for changes to the initial notification.
